KUYA PRIVACY POLICY

The Kuya Group, Inc., d/b/a hikuya or Kuya. (“Kuya”, “our”, “us”, or “we”) understands that privacy of personal information is a serious subject for our users.  We have published this Privacy Policy to help you better understand how we collect, use, protect, and share your Personal Data. This Privacy Policy is designed to help you understand your privacy choices when you visit our Websites (including the Kuya app) or use any of our Products. While it describes Kuya's internal policies and procedures, this Privacy Policy does not govern the conduct of any third party that may link to or be accessible from or through the Websites.
We encourage you to read this Privacy Policy carefully. By accessing the Websites and/or the Products, you acknowledge and agree to be bound by all terms and conditions in this Privacy Policy. If you do not wish to be bound, you may not access the Websites or the Products.
1. Definitions.
a. Information Types.
i. “Browser Information” means data or information provided by a browser, including the IP address, the website visited, and network connection.
ii. “Contact Information” means basic personal and business information, such as first and last name, company name, email address, postal address, phone number, and may include social media account information.
iii. “Device Information” means information about your device, such as device ID number, model, and manufacturer, version of your operating system and geographical region, collected from any devices when accessing our Websites or any of our Products.
iv. “Usage Information” means information collected when you interact with the Kuya Websites or any of our Products, including functionalities accessed, pages visited, and other interaction data.
b. “Controller” means an entity that determines the purposes and means of the Processing of Personal Data.
c. “Cookie” means a file stored on your computer’s hard drive that often contains an anonymous unique identifier that is accessible by the website that placed it there.
d. “Personal Data” or “Personal Information” means information that (i) relates to an identified or identifiable natural person, or (ii) identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer.
e. “Processing” means any operation or set of operations which is performed upon Personal Data, whether or not by automatic means, including, but not limited to, alteration, collection, organization, recording, retrieval, storage, transmission, and use.
f. “Processor” means the entity that processes Personal Data on behalf of the Controller.
g. “Products” means all Kuya content, products, services, and materials located on or accessible through the Websites.
h. “Third-Party Products” means any third-party information, website, product, service, or materials referenced in, accessible through, or provided in connection with, the Websites or Products.
i. “Visitor” means an entity or natural person that visits or interacts with the Websites.
j. “Websites” means the Kuya app for iOS or Android, the Kuya website located at https://hikuya.com, and all Kuya affiliated websites.
2. How Do We Collect Information and What Information Do We Collect?
a. When Visitors visit our Websites, or engage in communications with us, we may collect Browser Information, Contact Information, Device Information, Personal Information, and Usage Information.
b. We may collect the following types of information from you or your device(s):
i. identifiers, such as Browser Information and Device Information;
ii. commercial information, such as Contact Information and Usage Information;
iii. internet or network information, such as Browser Information and Device Information;
iv. geolocation data, such as Browser Information and Device Information;
v. other Personal Information, including driver’s license and patient identification; and/or
vi. information derived from other categories, which could include your preferences, interests, and other information used to personalize your experience.

3. How Do We Use the Information We Collect? We use the information we collect in our role as a Controller to:
i. provide our Products;
ii. confirm identities;
iii. to communicate with you, including required communications regarding updates to our Products or polices;
iv. to send promotional communications;
v. for advertising and marketing,
vi. to send you invoices for products and services you purchase;
vii. to resolve incidents or problems related to the use of our Websites and Products;
viii. for reporting to state regulatory agencies;
ix. to comply with legal requirements;
x. as may be necessary in a business transaction concerning the sale or transfer of our assets; and/or
xi. in other cases where the Visitor has given express consent.

4. How Do We Share the Information We Collect? We may share, transfer and/or disclose your Personal Information to or with service providers or third parties in order to provide the Products requested or purchased by you, and under the following circumstances:
a. We share certain Personal Information with our employees to provide you our Products; and third-party business partners necessary to provide the Products to you.
b. We may share Personal Information and other information we collect with our service providers and other third parties in connection with our marketing and business development efforts.
c. We share certain information that is traditionally not considered personally identifying information (such as device, analytics, and usage data) for purposes of better understanding usage of the Products and improving on your user experience.
d. We reserve the right to disclose Personal Information as permitted or required by law; when we believe disclosure is necessary to protect our rights; and/or in the event it is necessary to prevent, investigate or take action regarding unlawful, illegal or suspicious activity involving the Websites or Products.
e. We may share your Personal Information to comply with legal process, for example, in response to a court order or a subpoena, a law enforcement or government agency’s request, or similar request.
f. We may share your Personal Information with third parties in order to investigate, prevent, or take action (in our sole discretion) regarding potentially illegal activities, suspected fraud, situations involving potential threats to any person, us, or the Products, or violations of our policies or the law.
g. We may transfer Personal Information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about our Users is among the assets transferred.
We work with third-party service providers that supply website and application development, hosting, maintenance, storage, virtual infrastructure, payment processing, research, advertising, marketing, analysis, and other services for us, which may require them to access, store, or use your Personal Information. In particular, we engage and share certain Personal Information with third parties as follows: We use Loops for email marketing services. Third parties may collect additional information from you. Please refer to the respective third party’s privacy policy to better understand how they process any of the Personal Information they collect and the purposes for collection. While we are dedicated to securing our Websites and Products, you are responsible for securing and maintaining the privacy of your passwords and account information. We are not responsible for protecting Personal Information shared with a Third Party based on a connection that you have authorized.
We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.
5. How Do We Store the Information We Collect? Kuya may store and maintain collected information, which may include Personal Information, Contact Information, and Usage Information, for the period of time required by applicable state regulatory agencies or for the duration of your usage of our Products.
6. Promotional Offers from Kuya. If you do not wish to have your Contact Information used by Kuya to promote our Products, you can opt-out by sending us an email stating your request to privacy@hikuya.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions.
7. Data Subject Rights. State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information. The exact scope of these rights may vary by state. To exercise any of these rights please contact us, or have your authorized representative, contact us the address at the bottom of this page, or email us at privacy@hikuya.com, with the subject line “Data Subject Request”. In the event you have an authorized representative submit a request to delete, request to correct or request to know on your behalf, you will have to provide written authorization demonstrating this grant of authority, which can include a Power of Attorney. Authorized representatives may not submit any other types of requests on your behalf.  
For purposes of requests to delete, correct and to know, we will verify your identity based on information we have collected about you, including your name, address, and phone number, but will not fulfill your request unless you have provided sufficient information that enables us to reasonably verify that you are the consumer about whom we collected the Personal Information. If we are unable to verify your identity, we may deny your request.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
8. Rights of Users from the European Economic Area and the United Kingdom. If you are a resident of the United Kingdom (“UK”), European Union, or European Economic Area (“EEA”), you may have certain data protection rights. “GDPR” means the European Union General Data Protection Regulation (EU) 2016/679, and the United Kingdom Data Protection Act 2018. Information that you provide may be transferred or accessed by entities around the world as described in this Privacy Policy. If you are located in the EEA or UK, you freely consent to the transfer of personal information outside of the EEA and UK. Your consent to this Privacy Policy together with your submission of personal information constitute your agreement to these transfers. If you are accessing or using the Services from within the EEA or UK, you may have the following rights under the GDPR (as well as other rights). If you wish to exercise any of these rights, you may do so by contacting us as provided in this Privacy Policy.   
9. Credit Card Information.  Kuya does not process credit card information for payment for any Products you may order from our Websites. Kuya contracts with a third party service provider that complies with the payment card industry data security standards (PCI DSS) to collect and process your credit card information. We do not store or maintain any credit card information.
10. Cookies.
a. Usage. Kuya and its third-party service providers use cookies, web beacons, and similar tracking technologies to recognize you when you visit our Websites, remember your preferences, and give you a personalized experience. When you visit our Website, we, or an authorized third party, may place a Cookie on your device that collects information, including Personal Data, about your online activities over time and across different sites. Cookies allow us to track use, infer browsing preferences, and improve and customize your browsing experience.
b. Persistence. We use both session-based and persistent Cookies on our Websites. Persistent Cookies remain on your computer when you have gone offline, while session Cookies are deleted as soon as you close your web browser. A website may set a Cookie if the browser’s preferences allow it. A browser only permits a website to access the Cookies that it has set, not those set by other websites.
c. Types.
i. Essential. These Cookies are necessary for our Websites to work as intended.
ii. Functional. These Cookies enable enhanced functionality. Without these Cookies, certain functions may become unavailable.
iii. Analytics. These Cookies provide statistical information on site usage. For example, these Cookies enable web analytics that allow us to improve our website over time.
iv. Targeting and Advertising. These Cookies are used to personalize content to enhance your experience.
d. Control. It is possible to disable Cookies through your device or browser settings, but doing so may affect your ability to use our website. For instance, we may not be able to recognize your computer or mobile device and you may need to log in every time you visit our Websites. 11. Do Not Track. Do Not Track is a privacy preference that Visitors can set in their web browsers. When a Visitor turns on the Do Not Track signal, the browser sends a message to websites requesting them not to track the Visitor. At this time, we do not respond to web browser “do not track” settings or signals. We may deploy technologies on our Products to collect information about you and your browsing activity, even if you have turned on the Do Not Track signal.
12. Protecting Your Personal Information. We implement security measures designed to maintain the security of your Personal Information. These security measures are implemented both during transmission of Personal Information and once received. The security of your Personal Information is important to us. However, no method of safeguarding information is completely secure. While we use measures designed to protect Personal Information, we cannot guarantee that our safeguards will be effective or sufficient. In addition, you should be aware that internet data transmission is not always secure, and we cannot warrant that information you transmit utilizing the Products is or will be secure.
13. Transfer of Data. Your Personal Information may be transferred to--and maintained on--computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction. We will take steps reasonably designed to treat your Personal Information securely and in accordance with this Privacy Policy.
14. Updates. We may update this Privacy Policy from time to time in response to changing legal, technical or business developments. When we update our Privacy Policy, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any material Privacy Policy changes if and where this is required by applicable data protection laws. You can see when this Privacy Policy was last updated by checking the “Date of Last Revision” date displayed at the top of this Privacy Policy.
